Card Member Terms & Conditions for Airtel Payments Bank NCMC Enabled Cards
These terms and conditions apply to and regulate the issuance and usage of the Airtel Payments Bank NCMC Enabled Card offered by Airtel Payments Bank Limited (referred to as “Airtel Payments Bank”) in association with its Co-branding partner Transport Operator wherever applicable. These terms and conditions (the “Terms and Conditions”) shall be in addition to and not in derogation to any other terms as stipulated by Airtel Payments Bank or as issued by Transport Operator which entity had been working for.
1. Definitions
- Unless there is anything in the subject or context inconsistent therewith, the capitalised terms listed below shall have the following meanings:
- "Account" shall mean any savings/current account/wallet of the Cardholder with Airtel Payments Bank;
- “Airtel Payments Bank Website” shall refer to https://www.airtel.in/bank/, which is owned, operated and maintained by Airtel Payments Bank;
- “Transit Operator” The authority which runs the mode of transit, including but not limited to metro/buses/trains. This is the entity to which the Bank would settle collected funds: The terms "transit operator" and "transport operator" are synonymous and have been used interchangeably.
- "Alerts" shall mean the customized messages sent as short message service or WhatsApp, etc. over mobile phone or as message via electronic mail to the Cardholder based on instructions set out or placed by the Cardholder and/ or Airtel Payments Bank;
- “Applicable Law” shall mean and include all applicable statutes, enactments or acts of any legislative body in India, law, ordinances, rules, bye-laws, regulations, notifications, guidelines, policies, directions, directives and orders of any governmental authority and any modifications or re-enactments thereof;
- “Applicant” shall mean the person who makes an application by giving his/her acceptance on the online Application Form for issuance, by Airtel Payments Bank either by means of submitting a purchase request on Bank channels (Thanks App) or via sharing OTP based acceptance to Bank Agents for assisted issuance, of the EMV based Transit prepaid/debit card(s) to the Cardholder;
- “Application” shall mean Transport Operator website, Airtel Payments Bank website, mobile application of Transport Operator and utilised for application and issuance of EMV based Transit prepaid/debit card(s) to the Cardholder;
- “Application Form” shall mean the application form duly filled and submitted by the Applicant for issuance of the EMV based Transit prepaid/debit card(s) to the Cardholder, including all annexures and mandates thereto;
- "ATM" means any Automated Teller Machine in India or outside India, at which the Cardholder can use their Card to access their funds in their Account
- "Business Correspondent (BC)" shall mean a Bank’s representative engaged by the Bank for the extension of banking and financial services to ensure greater financial inclusion and increasing the outreach of the banking sector;
- "Card" shall mean the personalized/ non-personalized, debit/ATM/prepaid card, in digital/virtual or physical format, issued by Bank under the aegis of Card Schemes;
- “Cardholder” shall mean the individual to whom Airtel Payments Bank has issued the Prepaid/Debit Card(s)based on the application form submitted by the Applicant;
- "Card Schemes" shall mean organizations or card networks (including but not limited to VISA, MASTERCARD, RUPAY etc.) that process and settle Card’s Transactions as per the relevant rules formulated by such organizations or Card networks;
- "Designated BC Point" shall mean the retail business correspondent points engaged by Bank through which banking services are provided to customers;
- “Chip Balance/Global balance” shall mean amount written/ stored in the Card used for offline transactions.
- “Card Balance/Account Balance” shall mean the prepaid balance on the Card which is maintained at the Bank Level;
- “Customer Care” shall mean the telephonic customer service facility provided by Airtel Payments Bank to the Cardholders for any Card related queries, which number is set out as a part of the Welcome Kit issued to the customer
- "EDC" or "Electronic Data Capture" or “POS machine” or “point-of-sale device “shall refer to electronic point-of-sale swipe terminals located at Merchant establishments, whether of Airtel Payments Bank or any other bank on the shared network, that permit debiting of the account of Cardholder for purchase transactions from merchant establishments;
- “KYC Guidelines” shall mean the master direction for KYC issued by the Reserve Bank of India and its revision from time to time as applicable;
- “Merchant” means any person who owns or manages or operates a Merchant Establishment, as per guidelines issued by the Reserve Bank of India (RBI) from time to time;
- “Merchant Establishments” shall mean establishments wherever located that honor a VISA/MasterCard/Rupay and shall include among others, stores, shops, restaurants, hotels, airline organizations advertised as honoring the VISA/MasterCard/Rupay;
- "Personal Identification Number” / “PIN" means the Personal Identification Number chosen by the Cardholder in relation to the Card from time to time;
- "POS" means the point of sale (POS) electronic terminals in India or outside India, capable of processing Card Transactions and/or where the Cardholder can use their Card to access funds from the Account linked with the Card to make purchases at various merchant establishments in accordance with policies stipulated by the Bank and/or regulatory requirements from time to time and;
- “PPI Master Directions” shall mean the Master Directions on the Issuance and Operation of Prepaid Payment Instruments (Prepaid Payment Instrument) issued by the Reserve Bank of India and its revision from time to time as applicable; and;
- “Transaction(s)” shall mean any transaction(s) (including Card-not-present transactions) effected by utilising Card(s) including, without limitation from the Card(s);
- “Virtual Balance” is the replica of Global Balance available at the Bank end. This balance would be marked as hold balance in customer’s wallet/account and would be reserved for offline transactions on the Card. Since this is a replica of the actual Global Balance, it should not be considered as the actual balance on the chip.
2. Interpretation
- In these Terms and Conditions, unless the context otherwise requires:
- The singular includes the plural, and vice versa and words of any gender are deemed to include the other genders;
- The terms “hereof”, “herein”, “hereby”, “hereto” and derivatives or similar words refer to these Terms and Conditions;
- References to the words “include” or “including” shall be construed without limitation;
- Reference to any paragraph shall mean a paragraph of these Terms and Conditions;
- Reference to any legislation, law, circular or regulation or to any provision thereof shall include references to any such legislation, law, circular or regulation, as it may, after the date hereof, from time to time, be amended, supplemented or re-enacted, and any reference to a statutory provision shall include any subordinate legislation made from time to time, under that provision;
- The term “person” includes an individual, a partnership firm, a limited liability partnership, a company (as defined in section 2(20) of the Companies Act, 2013), a body corporate (as defined in section 2(11) of the Companies Act, 2013), a co- operative society, a trust, an association of persons whether incorporated or not and any other entity;
- Heading and bold typeface are used only for convenience and shall not affect the interpretation of these Terms and Conditions.
3. Applicability
- The Cardholder shall be deemed to have understood and unconditionally agreed to and accepted these Terms and Conditions by applying for the Card or by submitting the Application for the Card or by using or accepting the Card, in the form and manner prescribed by Airtel Payments Bank from time to time. The Cardholder shall be deemed to have understood and unconditionally agreed to and accepted the Terms and Conditions by acknowledging the receipt of the Card in writing and/or signing on the reverse of the Card, and/or by performing a transaction with a Card and will be bound by them and accept the onus of ensuring compliance with the relevant Reserve Bank of India (RBI) Regulations, Exchange Control Regulation of the RBI, all the rules and regulations framed under any Act or Statute and as amended /modified / applicable from time to time and any other corresponding enactment in force from time to time.
- The Cardholder will also continue to remain bound by the Terms and Conditions of operation of Card with Airtel Payments Bank.
4. Application for and Issuance of a Card
4.1 Cardholder can apply for the Card through an online mode - by visiting Airtel Thanks App or offline – by visiting Designated BC Point of the Bank. In case of offline mode, the Card shall be issued instantly, on the spot to the Cardholder by the designated BC Point of the Bank. The instant card can also be purchased from Designated Public Transport Operator locations like metro stations and bus depots where the Transport Operator has allowed issuance of the Card
4.2 With respect to the issuance of the Card, the Applicant shall submit to Airtel Payments Bank, complete Application Form and the information/ documents required by Airtel Payments Bank to be submitted including, without limitation, such information and documents as Airtel Payments Bank may require in respect of the person to whom the Card is required to be issued.
4.3 The Applicant shall, at the time of submitting the Application Form and documents, make payment of the amount to be loaded on the Card to be issued to the Cardholder in accordance with the procedure stipulated by Airtel Payments Bank in this regard and Applicable Law (including, without limitation, the PPI Master Directions).
4.4 Airtel Payments Bank may, at its sole discretion and subject to the fulfilment of such terms and conditions and completion of such other formalities that Airtel Payments Bank may specify from time to time, issue the Card to the Cardholder. The Applicant acknowledges and agrees that the issuance of the Card shall be the sole prerogative of Airtel Payments Bank and nothing contained in these Terms and Conditions (including, without limitation, the submission of the Application Form and/ or loading of amounts on to the Prepaid) should be construed as obliging Airtel Payments Bank to issue the Card to any Cardholder.
4.5 Bank reserves the sole discretion based on the risk perception to disable domestic Transaction or contactless Transaction on the Card with or without intimation to the Cardholder.
4.6. Bank shall also disable online /contactless transaction if the Card has never been used for any online /contactless Transaction by the Cardholder, as per the risk policy of bank
4.7 For verification of the Card, the Cardholder agrees to share the One-Time-Password (OTP) received on his registered mobile number for purchase of Card with Designated BC Agent. The Cardholder further agree to provide their biometric to the Designated BC Point for the issuance of the Debit Card.
4.8 The Card will be linked with the Account/wallet of the Cardholder opened with the Bank post successful purchase. Cardholder shall ensure to collect the welcome kit containing Card from the Designated BC Point or Transport Operator premises.
4.9 The Card shall be dispatched by Bank to the Cardholder at the address provided by Cardholder during issuance of the Card
4.10 The Cardholder shall ensure that the OTP triggered on registered mobile number with Bank/ necessary KYC proof \evidencing the actual identity of the Cardholder is kept ready for due verification by the courier agency at the time of actual delivery of the Card in physical format at the address communicated by the Cardholder to Bank at the time of applying for the Card. Bank reserves the discretion to not deliver the Card to any person acting on behalf of the Cardholder if the above mentioned documents are not made available to the courier agency at the time of delivery of the Card and the Cardholder shall not hold Bank responsible for the same.
4.11 Bank shall attempt thrice to deliver the Card to the Cardholder. If the Cardholder refuses to accept the Card and/or if the Cardholder is not present at the given address, the Card will be returned to origin (RTO) and the Cardholder may be informed by SMS on their registered mobile number. The Cardholder can track the status of the Card on Thanks App also. Bank shall wait for 90 (Ninety) working days from the date of delivery of first attempt to re-dispatch the Card to the Cardholder. The Cardholder can request for re-delivery by reaching out to the Bank’s call center. Post this period, Bank shall destroy the Card with or without intimation to the Cardholder and no amount shall be refunded to the Cardholder in such cases.
4.12 Bank shall not be responsible in any manner whatsoever for any loss and/or theft of or damage to the Card once the Card has been successfully handed-over to the Cardholder at the address communicated by him.
4.13 In the event of non-delivery of the Card for reasons not attributable to the Cardholder in any manner whatsoever, Bank shall first initiate the refund of the amount collected towards the issuance or any other cost associated with delivery of the Card to account/wallet of the customer
4.14 Personalized Card shall be dispatched to the Cardholder address in ~10-14 working days from the date of order confirmation received by the Bank, except for delay due to reasons beyond Bank’s control (or external circumstances).
5. Activation of the Card
5.1 The Cardholder and the Applicant hereby acknowledge and agree that the Card, as on the date of its issuance, shall be in a de-activated form
5.2 The Card shall be activated subject to: (a) the provision by the Cardholder and the Applicant to Airtel Payments Bank (and/ or its business correspondents/ sub-contractors) of such documents as Airtel Payments Bank may require to conduct its ‘know your customer’ (“KYC”) checks as well as any other documents required by Airtel Payments Bank; (b) the successful completion of the KYC checks in respect of the Cardholder and the Applicant by Airtel Payments Bank; and (c) the Cardholder accessing the mobile application or website of the Bank and enabling usage channels for the card, wherein for a card which is dispatched to the customer can only be enabled for E-commerce i.e card not present transactions(d)the Cardholder accessing web form or web link and confirming the receipt of the Card and providing such information and documents as Airtel Payments Bank may require in this regard and enabling channels for usage of card (e)by purchasing the card, the Cardholder provides consent for enabling usage of card in a contactless offline mode (f) the Cardholder setting card PIN directly at the issuance terminals of Airtel Payments Bank (and/ or its business correspondents/ sub-contractors)
5.3 Notwithstanding anything to the contrary contained herein, the Cardholder and the
a. Applicant acknowledge and agree that, in the event that there is any discrepancy in the KYC provided by the Cardholder and/ or the Applicant and/ or non-compliance of the Cardholder and/ or the Applicant with these Terms and Conditions, the KYC Guidelines and/ or the PPI Master Directions, Airtel Payments Bank shall be entitled, at its sole discretion, to immediately cancel/ suspend/ block the Card and shall not be liable for any inconvenience caused to the Cardholder and/ or the Applicant in this regard.
b. The virtual/digital card of the Cardholder can be issued once the Cardholder provides the m-pin on the card section of Banks’ - Airtel thanks app or in case of Insta card, once the Card is successfully issued to the Cardholder the digital card bearing the same card number will be issued. The successful authentication of MPIN on view virtual card ingress is the consent by Cardholder to generate a virtual card which will be govern by the T&C mentioned / published on the website from time to time. Digital card if issued before physical card, can be activated for the e-commerce transactions. Cardholder shall immediately activate the Card upon receipt, failing which no Transaction shall be allowed.
Features of Airtel Payments Bank NCMC Enable Card
6.1 The Cardholder may use the Card to make payments at E-commerce website, Merchant Establishments and transit operators within India. The facility to withdrawal cash shall not be available on the Card for Min KYC. No interest shall be payable by Airtel Payments Bank on the amount available / loaded on the Prepaid Card.
6.2 Airtel Payments Bank may, from time to time, at its discretion, tie-up with various agencies to offer various features on the Card. All these features would be on best-efforts basis only, and the Bank and/or Transport Operator does not guarantee or warrant the efficacy, efficiency, usefulness and/or continuity of any of the products or services offered by any service providers / merchants / outlets / agencies. Disputes (if any) would have to be taken up with the merchant / agency, etc. directly by Cardholder, without involving Airtel Payments Bank and/or Transport Operator.
6.3 The Cardholder may load and reload cash onto the Card at selected Service Delivery Outlets
subject to verification of their identity and any other mandatory requirements as prescribed by the Bank from time to time. Limitations regarding minimum amount, maximum amount, annual load limit and frequency of loading and reloading shall be applicable as prescribed by the Bank from time to time. The cash loading / reloading facility is subject to the relevant applicable fee(s) and may be loaded/reloaded by the Cardholder by visiting selected service outlets.
6.4 Up to 5 Airtel Payments Bank NCMC Enabled Card can be issued through one mobile number for a wallet customer. A Savings Account Customer would be issued a single NCMC Enabled Card on their account. The limit mentioned here The limit is exclusive of the cards which have been closed or dysfunctional The limit mentioned would include both Standalone or co-branded cards issued by the Bank
7. Usage of the Card by the Cardholder
7.1 The Cardholder and the Applicant acknowledge and agree that:
(a) the Card is valid only in India and only with respect to payments required to be made for goods and services at merchants and transit operators in INR;
(b) the Card is strictly not transferable and is the property of Airtel Payments Bank;
(c) the Cardholder shall be able to use the Card only to the extent of the Card Balance available at any given point of time;
(d) no interest shall be payable by Airtel Payments Bank on the prepaid Card Balance;
(e) All communications to the Bank in relation to the Card or Transactions should be made only by the Cardholder. Any communication by the Bank in relation to Cards shall be provided through the Bank’s website or shall be communicated directly to the Applicant through SMS/Email.
(f) the Cardholder and the Applicant shall comply with all Applicable Law.
7.2 The usage of the Card shall be governed by these Terms and Conditions and all policies, guidelines and instructions provided by Airtel Payments Bank, from time to time, in relation to the Card. Each time a Cardholder uses the Card to effect a Transaction, the Cardholder acknowledges and agrees that the Card Balance shall stand reduced by the value of the Transaction. The Cardholder acknowledges and agrees that notwithstanding anything to the contrary contained herein, Airtel Payments Bank may, in its absolute discretion, decline to honour any Transaction sought to be effected by utilising the Card despite there being sufficient Card Balance to complete such Transaction, without having to assign any reason thereof
7.3 The Cardholder acknowledges and agrees that the transaction specific personal identification number (“PIN”) provided in respect of the Card is required for effecting and authenticating Transaction on the Card. The PIN shall be set only by the Cardholder. The Cardholder shall keep the PINs confidential and well protected and should not reveal the same to any person, including to any employees and representatives of Airtel Payments Bank. Airtel Payments Bank shall in no way be held responsible, if the Cardholder incurs any loss as a result of the PINs being disclosed by the Cardholder to any third parties and/ or misuse of the Card by a person who has obtained the PINs. The Cardholder acknowledges and agrees that, at any point in time, Airtel Payments Bank may require the Cardholder to follow other technologies for authenticating Transactions and the Cardholder agrees and undertakes to do all such acts, deeds and things as Airtel Payments Bank may require in this regard.
7.4 The Cardholder shall ensure the following: (a) The Card is kept at a safe place;(b) The Card is not allowed to be used by any other individual; (c) The reverse of the Card is signed immediately upon receipt; (d) The PIN is never disclosed to any person or written down where any other person may discover it; (e) The responsibility for any misuse on the Card, once the Card (s) has been delivered at the address specified in the Application Form, will rest with the Cardholder and not Airtel Payments Bank.
7.5 The Cardholder acknowledges and agrees that Airtel Payments Bank may, from time to time, as per its internal policy, assign monetary thresholds/ limits on the amount of Transactions which may be effected in any particular day or other frequency subject to Applicable Law and Airtel Payments Bank’s internal policies and procedures. The Cardholder acknowledges and agrees that Airtel Payments Bank shall be entitled to refuse to process any Transaction once any such limits are exceeded irrespective of whether or not such limits have been previously communicated to the Cardholder.
7.6 Any Transaction undertaken shall be conclusive proof that the charge recorded for such Transaction was actually incurred by the Cardholder using the Card.
7.7 The Cardholder should ensure that the Card is used only once at a merchant location/ website for every purchase. Any charge or other payment requisition received from a merchant establishment shall be conclusive proof that the charge recorded was properly incurred by the Cardholder, except where the Card has been lost, stolen or fraudulently misused, the burden of proof for which shall be on the Cardholder.
7.8 All refunds and adjustments due to any merchant/ device error or error in the communication link will be processed manually and the account will be credited after due verification and in accordance with the relevant Card network rules and regulations as applicable. The Cardholder agrees that any debits received during this time will be honoured only based on the available balance in the Card without considering this refund.
7.9 Airtel Payments Bank or Transport Operator shall not in any manner be responsible for any disputes regarding goods and services received by the Cardholder including the quality, value warranty, delay of delivery, non-delivery, non-receipt of any goods or services. It must be clearly understood that the Card is only a facility to the Cardholder to avail facilities and Airtel Payments Bank holds out no warranty or makes no representation about quality, quantity, value, delivery or otherwise, howsoever regarding goods or services, and any such disputes should be resolved by the Cardholder with the merchant directly.
7.10 Card issued by the Bank shall contain information such as the name of the Cardholder (if personalized card), Card Number, CVV, Expiry Date etc. Card can be auto-renewed by the Bank .The renewed Card will be sent to the Cardholder’s registered mailing address. Upon activation of the new Card by the Cardholder, the old card will be deactivated. Cardholder can opt out from availing the Card services at any point of time by visiting the Designated BC Point
7.11 Penalty amount can be configured by Transport Operator and charged to customer’s card if the previous transaction in not complete, i.e. no exit (tailgating).. The executive would debit penalty and clear the error code on the card. These penalties would be configured at the merchant end as per the rules defined by Transport Operator
7.12 Bank can receive offline transactions from respective Merchants on a subsequent days from the original date of transactions. These transactions should ideally be received within T+4 days but in exceptional circumstances can also be received with a further delay. Bank would debit all such offline transactions from the Virtual Balance
7.13 The customer shall be able to load their Global Balance upto a max permissible limit set by the Bank for loading of card in line to RBI guidelines. Customer would not be able to load balance on the chip of the card beyond this limit. In case a customer has loaded amount online and then tries to sync the chip balance at designated terminals, if the chip balance exceeds the permissible limit and balance sync would be declined. Any balance which would be kept on hold as Virtual Balance would be release into customer’s wallet/account.
7.14 Cardholder to ensure that they perform atleast one online transaction after every 20 non-transit offline transactions.
Discount on Metro/Bus Rides
The Cardholder shall understand and agree to the fact that any discount offered on metro/bus fare or metro/bus passes is entirely upon discretion of Transport Operator and Airtel Payments Bank shall have no say, right or obligation on such discount. Since, the Prepaid/Debit Card can be a Co- Branded Card in association with the authority, Transit Operator shall decide on percentage or maximum and minimum amount of discount to be offered on metro/bus ride paid through Airtel Payments Bank NCMC Enabled Cards. The said discount shall apply upon usage in metro gates or ticket issuance counters as per operating procedures laid down by Transport Operator authorities.
9. Fees and Service Charges
9.1 Airtel Payments Bank reserves the right to levy fees** at a later date, without prior notice, to the Cardholder. Such fees if any, and so levied, will be debited from the Card account at Airtel Payments Bank's prevailing rate. These fees are non-refundable. Charges for other services will be levied similarly at prevailing rates. The Cardholder and the Applicant hereby agrees to make payment of such charges.
9.2 The Charges / Fees applicable on the usage of the Card maybe revised / changed by Airtel Payments Bank from time to time after due notice of 30 days or as per regulation to the Cardholder(s).
9.3 Airtel Payments Bank reserves its right to debit loading* / annual / renewal charges and other services charges as applicable, on the Card upon first reload or from time to time.
9.4 Airtel Payments Bank reserves the right to recover the Annual fee charges basis calendar year and pro rata from the date of issuance of Card.
9.5 Airtel Payments Bank reserves its right to debit the outstanding dues, if any, in full or part, as applicable on the Card at the time of closure / cancellation of the Card / withdrawal of any facility.
9.6 No interest shall be payable by Airtel Payments Bank on the amount available/loaded on the prepaid card
9.7 Any government charges, duty, debits or tax payable as a result of the use of the Card shall be borne solely by the Cardholder/ Applicant and if the same is imposed upon Airtel Payments Bank (either directly or indirectly), the Cardholder/ Applicant hereby agrees to make payment of such charges
9.8 Without prejudice to the Cardholder’s/ Applicant’s obligation to make payment of the fees, charges, duties or taxes payable in respect of the Card and the use thereof, Airtel Payments Bank shall be entitled to recover all amounts due from the Cardholder/ Applicant to Airtel Payments Bank including, without limitation, the amounts payable by debiting the available Card Balance

** Fees would include card renewal charges, annual charges, card closure fees and/or any other outstanding amounts on the Card/s.
10. Transactions on NCMC Enabled Card
10.1 Financial transactions would include the following:
a) Ticket purchase transaction at transit operators like metros, state road transport buses,
b) Facilitate the cardholder to take the journey from one station to another
c) Pass purchase (at Transport Operator Station Counters or Bank designated outlet);
d) Pass renewal (at Transport Operator Station Counters or Bank designated outlet);
e) Card top-up (at Transport Operator Station Counters or Mobile Application of Transport Operator or NCMC Enabled Card Self-Care Portal);
f) Cash loading from selective service outlets shall be limited subject to overall limit of the PPI as per RBI guidelines as amended from time to time for full KYC Cards;
g) Retail payments made through POS terminals.
h) Online or E-commerce website purchases
i) ATM transactions including cash withdrawal, Balance inquiry and Mini Statement for customers with Savings Account of Full KYC customers of the Bank
10.2 Non-financial Transactions would include the following:
a) PIN Set (at Transport Operator Station Counters and Thanks App);
b) Balance enquiry (at Transport Operator Station Counters, through Thanks App,ATM/mATM);
c) Card Blocking (through Customer Care centre, Thanks App) and;
d) Card Replacement (at Transport Operator Station Counters and bank designated outlets);
e) Mini Statement (ATM/mATM). * As applicable.
11. Lost or Stolen Card
11.1 If the Card is lost or stolen, the Cardholder must immediately report such loss/ theft over the telephone to the Customer Care. On receipt of any such intimation Airtel Payments Bank shall, , upon adequate verification of the Cardholder, hotlist/ cancel/ suspend/ block the Card and terminate all facilities in relation thereto and shall not be liable for any inconvenience caused to the Cardholder in this regard. The Cardholder will be liable for all charges incurred on the Card until it is reported lost/ stolen. Further, in the event Airtel Payments Bank determines the aforementioned steps are not complied with, the financial liability with regard to the lost or stolen Card would rest entirely with the Cardholder. In case of any dispute relating to the time of reporting Transaction(s) made on the Card or any other matter in relation to the lost/ stolen Card, the determination of Airtel Payments Bank shall be conclusive and binding on the Cardholder.
11.2 While the Bank would block/hotlist the card once the card is reported as lost/stolen, the Bank would not be liable to refund the chip/global balance on the card. The Bank would continue to receive offline transactions for transactions done prior and post the card reported as lost/stolen. The amount remaining as the chip balance in the card would be kept on hold till the expiry of the card. The unutilized chip balance would be released into customer’s wallet or savings bank account within 5-7 days of card expiry.
11.3 The Cardholder understands that any request for permanent blocking of the Card shall result in the blocking of the Card in electronic format as well and shall disable all types of Transactions including online & contactless on the Card.
11.4 The Cardholder must also report the misuse or loss of his Card to the police and lodge a First Information Report ("FIR"), whether in India or overseas, and send a copy thereafter to the Bank via email (wecare@airtelbank.com) or at Bank’s call centre. The Cardholder will be liable for all the charges incurred on the Card until the Card is hotlisted. In case of an unsigned Card, the Cardholder will be liable for all charges incurred on it. The Cardholder may report a Card loss over the telephone to the Bank. The Bank upon adequate verification will suspend the Card and will not be liable for any inconvenience caused to the Cardholder on this account. The Bank will hotlist / cancel the Card during 24X7 hours following the receipt of such intimation. Other channels for hotlisting may be offered to the Cardholder as and when the service is launched. In the event the Bank determines that the aforementioned steps are questionable, financial liability on the lost or stolen card would rest with Cardholder.
12. Surrender/Replacement of Card
12.1 The Cardholder acknowledges and agrees that Airtel Payments Bank shall be entitled to demand the surrender of the Card at any time, including at a time prior to the expiry of the validity period of such Card. The Cardholder shall, forthwith upon such demand being made, surrender the relevant Card in accordance with the instructions provided by Airtel Payments Bank in this regard.
12.2 Airtel Payments Bank may issue a replacement Card to the Cardholder upon a request being made by him/her, in this regard and at its sole discretion. The replacement Card shall be issued to the Cardholder on payment of the issuance fee at the issuance point.
12.3 In the event of demise of any Cardholder, Airtel Payments Bank shall cancel the Prepaid/Debit Card upon being informed of the same.
12.4 If the card is being physically submitted for replacement by the customer, the customer would be eligible for transfer of chip balance to the replaced card. The executive would read the card balance and transfer the balance amount to the new card. In the event that chip balance cannot be read at the terminals or the chip being destroyed, the balance would be transferred within 5-7 working days after deducting any pending transactions.
12.5 If the card is physically submitted for closure by the customer, , the customer would be eligible for transfer of chip balance to the account/wallet. The executive would read the card balance and transfer the balance amount customer’s wallet/account. In the event that chip balance cannot be read at the terminals or the chip being destroyed, the balance would be transferred within 5-7 working days after deducting any pending transactions.
13. Card Inactivity
13.1 If there is no financial transaction for a consecutive period of one year then the Card shall be made inactive by Airtel Payments Bank. The Bank shall also share an intimation to the Cardholder via an Alert to this effect.
13.2 The Card can be reactivated only after customer validation by Airtel Payments Bank
13.3 The Card may be reported to RBI as per their instructions and directions.
13.4 The Cardholder may be permitted to redeem the outstanding balance on the Card, if for any reason the scheme is being wound up or is directed by RBI to be discontinued.
14. Validity
14.1 The Airtel Payments Bank NCMC Enabled Card shall be valid up to a period of upto 5 (Five) years from the date of issuance of the Prepaid/Debit Card subjective to card expiry.
14.2 Notwithstanding anything to the contrary contained herein, Airtel Payments Bank shall be entitled to, at any time, with or without notice to the Cardholder and/ or the Applicant, at its absolute discretion, terminate / de-activate the Prepaid/Debit Card.
14.3 The Cardholder agrees to surrender the Prepaid/Debit Card to Airtel Payments Bank or its representative, upon being requested to do so and shall not use or attempt to use the Prepaid/Debit Card after termination / de-activation of such Prepaid/Debit Card.
14.4 The Cardholder may, at any point of time, request for deactivation of the Prepaid/Debit Card by contacting Customer Care and submitting such documentation as may be required in line with Airtel Payments Bank’s policies and guidelines in this regard. The Cardholder may also provide details of the account/ prepaid instrument where transfer of the Card Balance can be affected by Airtel Payments Bank on such deactivation/ expiry provided that such transfer shall be affected in the manner and subject to Applicable Law and Airtel Payments Bank’s internal policies and procedures.
14.5 The Cardholder agrees and confirms that any unclaimed balance amount in the Card for more than ten years will be transferred to the Depositor Education and Awareness Fund (DEAF) as per RBI circular RBI/2013-14/527 DBOD.No. DEAF Cell.BC.101/30.01.002/2013-14.
15. Statements and Records
15.1 The Cardholder can also get details of his/her transactions at any time, by calling Airtel Payments Bank customer care number or by accessing the Thanks App
15.2 Airtel Payments Bank's record of transactions processed by the use of the Card in electronic or documentary form of the instructions (including but not restricted to payments made or received) is available on the Thanks App which shall be conclusive and binding for all purposes.
15.3 The Cardholder can view card transaction history through the ThanKs App
15.4 The Cardholder will also receive a SMS on the mobile number registered by the Cardholder with the Bank, after each transaction, informing about the transaction value
15.5 The Cardholder shall inform Airtel Payments Bank in writing within 30 days, if any irregularities or discrepancies exist in the transactions/ particulars of the Card Account on any statement that is made available to the Cardholder. If Airtel Payments Bank does not receive any information to the contrary within 30 days, it shall be assumed the statements and the transactions to be correct.
16. Disputes
16.1 Airtel Payments Bank shall not in any manner be responsible for any disputes regarding goods and services purchased by the Cardholder using the Card including, without limitation, the quality, value, warranty, delay of delivery, non-delivery, non-receipt of any goods or services. The Card is only a mode available to the Cardholder to make payment to merchants and any disputes relating to the goods or service purchased by the Cardholder, which arise for any reason whatsoever, should be resolved by the Cardholder with the merchant directly and Airtel Payments Bank shall have no obligation or responsibility in respect thereof.
16.2 Airtel Payments Bank shall not be liable to the Cardholder and the Applicant in respect of any loss or damage arising directly or indirectly out of: (a) any unauthorized use of the Cardholder's/ Applicant’s mobile phone number; (b) any error, default, delay or inability of Airtel Payments Bank to act on all or any of the Alert; (c) any loss of any information/instructions/Alerts in transmission; (d) any unauthorized access by any other person or any information/ instructions given by me or breach of confidentiality.
16.3 The Cardholder shall inform Airtel Payments Bank, by contacting the Customer Care, within 30 days of occurrence of any Transaction, if any irregularities or discrepancies exist in such Transaction or if such Cardholder has any query or complaint in relation to the Transaction. If Airtel Payments Bank does not receive any information to the contrary within 30 days of occurrence of any Transaction, it shall be entitled to assume and proceed on the basis that the relevant Transaction(s) was effected without any irregularity/ discrepancy.
16.4 In respect of any complaints/ query raised by the Cardholder and/ or the Applicant in terms of these Terms and Conditions, the Cardholder and/ or the Applicant shall be required to promptly provide Airtel Payments Bank with all such information and documents as may be required by Airtel Payments Bank in this regard.
16.5 Please note that Airtel Payments Bank does not ask its customers for any confidential information, and therefore the Cardholder and/ or the Applicant must not share any information of a confidential nature including, without limitation, passwords, user- IDs, etc., to any person who asks for the same. 17. Express Consent/Waiver for Disclosure of Information
17.1 The Cardholder and the Applicant hereby authorise Airtel Payments Bank and/ or its associates to verify any information or otherwise at the Cardholder’s and/ or the Applicant’s office/ residence or to contact the Cardholder (and/ or the Applicant)/ the Cardholder’s employer (and/ or the Applicant’s employer)/ banker/ credit bureaus/ the Reserve Bank of India or any other source to obtain or provide any information that may be required for confirming membership requirements or maintaining the Cardholder’s/ Applicant’s account in good credit standing.
17.2 Notwithstanding anything to the contrary contained herein, the Cardholder and the Applicant hereby expressly consent and authorise Airtel Payments Bank (whether acting by itself or through any of its service providers, and whether in automated manner or otherwise), to do and undertake any of the following, in relation to any information in respect of the Cardholder and/ or the Applicant including, without limitation, any information contained in the documents submitted/ executed by the Cardholder and/ or the Applicant and/ or any other information relating to the Cardholder and/ or the Applicant and the usage of the Card collected by Airtel Payments Bank now or hereafter, any personal data and sensitive information about the Cardholder and/ or the Applicant, information, papers and data relating to know-your-customer, credit information, and any other information whether about the Cardholder and/ or the Applicant (collectively, “Information”):
(a) to collect the Information from the Cardholder and/ or the Applicant and other physical or online sources including, without limitation, accessing the same from credit information companies, websites, data bases and online platforms (whether public or not), to get the authenticity, correctness, adequacy, etc. of the Information verified from any sources and persons including, without limitation, from any online data bases;
(b) process Information including by way of storing, structuring, organising, reproducing, copying, using, profiling, etc. as may be deemed fit by Airtel Payments Bank;
(c) to store the Information for such period as may be required for contract, by law or for Airtel Payments Bank’s evidential and claims purposes, whichever is longer;
(d) disclose, exchange, share or part with, from time to time without notice to the Cardholder and/ or the Applicant, the Information to any other person including, without limitation, any Card issuer, credit bureau, banks, financial institutions, any branch, parent/ subsidiary, affiliate, group companies and associates of Airtel Payments Bank, governmental/ regulatory authority, service provider, business correspondent, agent or third party sub-contractor, consultants, credit information companies, regulators, investigating agencies, judicial, quasi-judicial and statutory authorities for such purposes that Airtel Payments Bank may deem fit. The Cardholder and the Applicant hereby waive the privilege of privacy.
17.3 The Cardholder and the Applicant hereby authorise Airtel Payments Bank to record specific conversations between the Cardholder/ Applicant or the Cardholder’s/ Applicant’s representative and Airtel Payments Bank's representative, in case of grievance related conversations or payment recovery related conversations or any other conversation that Airtel Payments Bank may deem fit, at its own discretion.
17.4 The Cardholder and the Applicant hereby consent to receive information/ service for marketing/ cross-selling purposes through telephone/ mobile/ short message service/ e-mail or any other mode from Airtel Payments Bank and/ or its agents. The Cardholder and the Applicant understand that in case that the Cardholder and/ or the Applicant do not wish to receive promotional information through telephone calls/ emails/ short message service on products and services not currently availed by the Cardholder and/ or the Applicant, the Cardholder and/ or the Applicant can register for “Do Not Call” service through the Airtel Payments Bank Website or through phone banking or other channels that Airtel Payments Bank may offer. The Cardholder and the Applicant agree that this service will not apply to receipt of advice and information regarding products and services currently availed by the Cardholder/ Applicant, to help the Cardholder/ Applicant in fully realising the benefits of the range of financial solutions designed to make the Cardholder’s/ Applicant’s banking relationship value added and more convenient.
17.5 The Cardholder understands that the Card is issued by furnishing minimum details. The Card holder will be required to furnish complete KYC details within 2 years/24 months of Card issuance or as per the prevailing statutory and regulatory guidelines. If the Cardholder fails to furnish the complete KYC details within 2 years/24 months of Card issuance, then no further top up will be allowed on such Cards and Cardholder will only be allowed to use the available balance on his Card for any transactions until complete KYC is furnished and updated.
18. Governing Law and Jurisdiction
18.1 The construction and validity of these Terms and Conditions shall be governed in all respects by the laws of India. The Cardholder and the Applicant agree that any legal action or proceeding arising out of these Terms and Conditions shall be brought before the courts or tribunals at Delhi and irrevocably submit themselves to the jurisdiction of that court or tribunal. Airtel Payments Bank may, however, in its absolute discretion, choose to commence any legal action or proceedings arising out of these Terms and Conditions in any other court, tribunal or other appropriate forum and the Cardholder and the Applicant hereby consent to such jurisdiction and waives any objection that the Cardholder and the Applicant may have now or in the future to the laying of the venue of any such legal action or proceedings and any claim that any such legal action or proceedings have been brought in an inconvenient forum.
19. Exclusion from Liability
19.1 Without prejudice to any other provisions of these Terms and Conditions, Airtel Payments Bank shall not be liable to the Cardholder and/ or the Applicant for any loss or damage whatsoever or however caused or arising, whether directly or indirectly, in connection with these Terms and Conditions, including, without limitation, any loss or damage arising from: (a) the refusal of any person to honour or to accept the Card; (b) handing over of the Card by the Cardholder or by the Applicant to any person other than a representative of Airtel Payments Bank at the time of the surrender of the Card; and/ or (c) any interruption or stoppage in the Cardholder's access to and/ or the use of the Card.
20. Indemnity
20.1 In consideration of Airtel Payments Bank providing the Cardholder with the Card, the Cardholder and the Applicant hereby expressly and unequivocally agree to indemnify, save, defend and hold harmless, Airtel Payments Bank and its officers, directors, employees, shareholders, agents, consultants and other representatives indemnified from and against all actions, claims, suits, demands, proceedings, losses, damages, personal injury, costs, charges and expenses of any nature whatsoever which Airtel Payments Bank and its officers, directors, employees, shareholders, agents, consultants and other representatives may, at any time, incur, sustain, suffer or be put to incur, sustain or suffer, as a consequence of, or by reason of or arising out of provision of the Cards including, without limitation, in the following cases: (a) the negligence, mistake or misconduct of the Cardholder and/ or the Applicant; (b) breach or non-compliance by the Cardholder and/ or the Applicant of the these Terms and Conditions or any Applicable Law; (c) any claim made or proceeding commenced by any third party against Airtel Payments Bank, in relation to or in connection with the issuance/ usage of the Card and/ or any Transaction; (d) any action taken or omitted to be taken by Airtel Payments Bank, its officers, employees or agents, on the instructions of the Cardholder and/ or the Applicant; and/ or (e) fraud or dishonesty relating to any Transaction by the Cardholder.
21. Set-Off and Lien
21.1 Notwithstanding anything to the contrary contained in these Terms and Conditions or any other document/ arrangement: (a) in respect of all and any of the Cardholder’s and the Applicant’s present and future liabilities to Airtel Payments Bank, whether under this document or under any other obligation/ loan/ facilities/ borrowings/ document, whether such liabilities are/ be crystallised, actual or contingent, primary or collateral or several or jointly with others, whether as principal debtor and/ or as guarantor and/ or otherwise howsoever (collectively “Liabilities”), Airtel Payments Bank shall in addition to any general lien or similar right to which it as a banker may be entitled by Applicable Law, practice, custom or otherwise, have a specific and special lien on all the Cardholder’s and the Applicant’s present and future stocks, shares, securities, property, book debts, all moneys in all accounts whether current, savings, overdraft, fixed or other deposits, held with or in custody, legal or constructive, with Airtel Payments Bank, now or in future, whether in same or different capacity of the Cardholder and the Applicant, and whether severally or jointly with others, whether for any banking relationship, safe custody, collection, or otherwise, and (b) separately, Airtel Payments Bank shall have an express right to, without notice to and without consent of the Cardholder and of the Applicant, set-off, transfer, sell, realise, adjust, appropriate all such amounts in all accounts (whether prematurely or upon maturity as per Airtel Payments Bank’s discretion), securities, amounts and property as aforesaid (whether earmarked for any particular Liability or not) for the purpose of realising or against any of dues in respect of any of the Liabilities and to combine or consolidate all or any of accounts of the Cardholder and to set-off any monies, whether of same type or nature or not and whether held in same capacity or not including upon any default in payment of any part of any of the Liabilities when due in terms of such documents.
22. Notification of Changes
22.1 Airtel Payments Bank shall have the absolute discretion to, at any point of time, (a) amend or supplement any of these Terms and Conditions; and/ or (b) change any feature and/ or benefit offered on the Card including, without limitation, changes which affect charges or rates and/ or method of calculation of charges with respect to the Card. Airtel Payments Bank shall communicate the amended terms, the changes made to the features of the Card, and the revised interest, charges and rates with respect to the Card, by hosting the same on the Airtel Payments Bank Website or in any other manner as may be decided by Airtel Payments Bank, from time to time. The Cardholder and the Applicant shall be responsible for regularly reviewing the latest versions of the Terms and Conditions as may be posted on the Airtel Payments Bank Website, from time to time, and shall be deemed to have accepted the amended Terms and Conditions by continuing to use the Card after the amended Terms and Conditions are hosted on the Airtel Payments Bank Website.
23. General Covenants
23.1 The Cardholder and the Applicant acknowledge, agree and confirm that Airtel Payments Bank may, in relation to these Terms and Conditions and / or the Card, utilise such business correspondents / third party sub-contractors / agents / service providers as it may deem fit.
23.2 The Cardholder and the Applicant hereby acknowledge, agree and confirm that the Cardholder and the Applicant have read and understood Airtel Payments Bank's customer protection policy available on the Airtel Payments Bank’s Website https://https://www.airtel.in/bank and acknowledge and agree to be bound by the same in respect of the Card including without limitation in case of use of the Card by a person other than the Cardholder.
23.3 The Cardholder and the Applicant acknowledge, agree and confirm that these Terms and Conditions are solely between Airtel Payments Bank and the Cardholder/ Applicant and no other third party has any rights or obligations hereunder.
23.4 The Applicant accepts the Terms and Conditions by the submission of the Application Form and on such submission, the Terms and Conditions shall represent the agreement between the Applicant and Airtel Payments Bank with respect to the Card and the subject matter of these presents.
23.5 The Cardholder accepts the Terms and Conditions by usage of the Card and on the first usage of the Card, the Terms and Conditions shall represent the agreement between the Cardholder and Airtel Payments Bank with respect to the Card and the subject matter of these presents.
